General Description POSTING TYPE: Open-competitive DEPARTMENT: County Attorney HOURS: Full-time LOCATION: Judicial Center, Hastings UNION: Attorney Employees' Association CLOSE DATE: 4:30 p.m. on Tuesday, October 1, 2024 SALARY RANGE: The position level at which the offer is extended is based on the candidate's ability to meet the minimum qualifications and the candidate s relevant years of experience. . * Attorney II - $84,851 - $132,580 Attorney III - $95,034 - $148,490 ** Attorney IV - $106,438 - $166,309 Our current vacancy is within the Juvenile, Protective Services & Appellate Division (JPSA Division) of the County Attorney s Office. Attorneys in the JPSA Division may be assigned to represent the interests of Dakota County in civil legal matters involving child protection, civil commitment or guardianship/conservatorship actions involving vulnerable adults; represent Dakota County in juvenile delinquency matters; as well as other responsibilities as assigned by the JPSA Division Head, Chief Deputy, or County Attorney. The specific assignment within the Division will be determined based upon the candidate s experience and the needs of the JPSA Division. Duties & Responsibilities These examples do not include all possible tasks in this work and do not limit the assignment of related tasks in any position of this classification. Specific duties and responsibilities will depend on experience and Attorney level. Regular attendance according to the position's management approved work schedule is required for all positions. 1. Review evidence to determine whether it is admissible and whether a petition or complaint may be issued. 2. Draft petitions, complaints, warrants, motions, memoranda, findings, orders, stipulations, and other legal documents in assigned cases of moderate complexity or difficulty. 3. Prepare assigned cases for trial before judge, jury, magistrate or referee; interview witnesses; plan and organize opening statements, direct and cross-examinations and closing arguments; plan and organize admission of documentary and physical evidence. 4. Represent the State of Minnesota or Dakota County in assigned court cases; try cases and contested motions before judge, jury, magistrate or referee; present oral arguments in bail, motion, review, dispositional or other court hearings. 5. Advise law enforcement, child protection workers, adult protection workers, child support officers and other County officials and employees regarding legal authority, duty and liability related to criminal investigations or civil litigation. 6. Give basic and more complex advice to County staff regarding legal obligations, authority, duty and liability. 7. Draft basic and moderately complex contracts and agreements or other documents which establish legal rights of Dakota County. 8. Prepare legal memoranda to County staff or for supervisory attorney. 9. Attend staff and other required meetings. 10. Attend continuing legal education courses. 11. Prepare appellate briefs and argue cases in appellate court. 12. Perform other duties as assigned by Criminal Division Head, Chief Deputy, First Assistant or County Attorney. Essential Job Functions: Duties 1-8 and 10-11 are essential functions. Knowledge, Skills & Abilities and Work Environment Sufficient knowledge of state and federal constitutional law, statutes, and court rules to effectively and efficiently JPSA case types and/or resulting appeal with minimal guidance and supervision. Knowledge of the applicable Rules of Professional Responsibility. Ability to analyze facts in light of applicable laws and evidentiary rules. Excellent verbal and written communication skills. Ability to plan, organize and present a case. Ability to perform work effectively, independently and in a timely manner. Competency in the use of computers, business software applications and Internet resources to perform essential job duties. Establish and maintain cooperative and effective working relationships. Work Environment Work is primarily sedentary, although there is some walking, travel, and carrying of lightweight items such as briefcases, notebooks, and work papers. The work is typically performed in an adequately lighted and climate-controlled office. Equipment used may include, but is not limited to computer/laptop, printer, scanner, telephone, and copy machine. Location & Schedule This is a hybrid position that offers a mix of telework and in-person work at our Judicial Center in Hastings, MN. Work is performed Monday through Friday during regular business hours.
