The Assistant General Counsel, Compliance will be a member of the Ethics & Compliance organization and will report to the SVP, Chief Ethics & Compliance Officer. The successful candidate will serve as the Compliance Officer for at least two BD Business Units, providing counsel on a wide range of compliance matters. The successful candidate will be responsible for executing on BD’s compliance strategy within these business units and for supporting projects and programs for the broader compliance organization as well as other business and functional teams.

This role is a unique opportunity for an individual to serve as a trusted advisor and astute business partner who will collaborate effectively with various stakeholders and leaders to assist the Company in meeting business objectives while ensuring healthcare compliance and mitigating risk. The position requires a superior understanding of the legal and compliance implications of business decisions and will play a significant role in enabling the Company and its professionals to develop and deliver its products and offerings to customers effectively and efficiently, while appropriately managing risks in the heavily regulated environments in which the Company operates. The successful candidate will be a “hands-on” attorney who is able to operate autonomously, yet effectively collaborate across a matrixed organization.

This position will have direct client contact at the business unit leadership level. The successful candidate will have the opportunity to make an immediate contribution to BD’s continuing growth and success. Job Description

The responsibilities of the position include:

  • Acting as a leader in Ethics & Compliance and providing compliance risk management oversight and guidance to colleagues in the aligned Business Units.

  • Overseeing a comprehensive compliance strategy and operational approach to establish a culture of accountability and compliance in the aligned Business Units.

  • Serving as a strategic partner to business leaders, sales leaders, and other relevant management personnel on compliance matters.

  • Developing strong relationships throughout all functional areas, departments, and divisions to foster a collaborative approach to proactive compliance.

  • Chairing relevant Business Unit Compliance Committees and other applicable committees to align with key stakeholders on compliance risks and mitigation objectives and elevate key risks/trends to the appropriate business personnel.

  • Maintaining current working knowledge of key laws and regulations, including the False Claims Act, Anti-Kickback Statute, the Sunshine Act and relevant state laws.

  • Proactively understanding the evolution of the compliance requirements and enforcement landscape relevant to the aligned Business Units to proactively address and mitigate regional compliance risks.

  • Providing regular updates on compliance risk management to appropriate cross-functional stakeholder groups within the aligned Business Units ( e.g. , legal, internal audit, finance, regulatory, HR, medical affairs, marketing, sales).

  • Developing and presenting relevant compliance metrics for internal audiences.

  • Conducting, managing, and resolving compliance investigations, as necessary.

  • Supporting compliance due diligence for new business and product acquisitions.

  • Serving as Compliance lead on integration of acquisitions for aligned Business Units.

  • Developing and implementing auditing and monitoring programs to evaluate the company’s compliance with applicable laws, regulations and company policies.

  • Reviewing education and research grant proposals, charitable contributions, and sponsorship.

  • Partnering with leadership to ensure the achievement of strategic business and corporate governance requirements associated with compliance matters.

  • Ensuring proper resource planning and management of outside counsel.

Education / Certifications

  • The successful candidate will hold a law degree with strong academic credentials from an accredited law school and will have obtained an undergraduate degree from a college or university of recognized standing.

  • She/He/They will be licensed in good standing to practice law in at least one state and one federal jurisdiction within the United States without any instances of suspension, revocation, censure or other adverse events in any jurisdiction, whether or not the candidate is currently admitted to practice in that jurisdiction.

Professional qualifications

  • 10+ years of relevant healthcare compliance law experience.

  • Strong knowledge and understanding of healthcare laws and regulations, including the False Claims Act, Anti-Kickback Statute, the Sunshine Act and relevant state laws.

  • Experience with federal and state healthcare program reimbursement rules and regulations for medical supplies ( e.g. , Medicare, Medicaid) is a plus.

  • Experience with the legal issues specific to the operation of a durable medical equipment (“DME”) provider is a plus.

  • Demonstrated ability to effectively communicate with and influence a wide spectrum of individuals: from government officials, to attorneys, executives, associates and agents.

  • Demonstrated ability to lead and/or play a key role in cross-functional project teams.

  • Superior writing skills with an ability to present nuanced, complex and content rich issues in a manner appropriate for the intended audience.

  • Demonstrated ability to exercise independent judgment effectively. Ability to draft and implement key corporate policies and procedures to empower and enable associates to achieve business objectives in a compliant manner.

  • Demonstrated ability to manage other associates within the Ethics & Compliance function, and to collaborate with peers and cross-functional partners in a matrixed organization.

  • Tech savvy with excellent presentation, training and people skills.
